Mobile driving is offensive

Just heard on the BBC 4 news that it’s possible that UK law may be amended to make using a mobile phone while driving a specific offence - makes sense as with a phone in your hand you aren’t in full control of the car. Hands-free phone will be excluded.
Here’s the weird bit – calls made with handheld phones with an earpiece and microphone will be an offence. What sort of logic is that? Hands-free - OK, earpiece - not OK.
Oh I get it, sales of mobile phone are levelling out due to saturation, so now everyone will have to buy a car kit as well now. Was this idea sponsored by the mobile phone manufacturers and retailers?
