BT Openreach - A Sham

Steve Kennedy has written a great piece on Digital-Lifestyles where he strips the away the hype from the formation of BT OpenReach, the company that is supposed to make LLU a more level playing field in the UK.
The lack of LLU competition (letting other companies apart from BT put their equipment in local exchanges, to offer competing services) has lead the UK to the point where BT letting people have a 2Mb is seen as a big deal.
BT OpenAccess is pure BT - something that looks like they shifting away from dominating and restricting the market, but instead know that they’ve planned the two moves beyond what they’ve let go - and that it will all work in their favor.
The thing that confuses me? Why does Ofcom let them get away with it? They’re stating to look like the manipulated mugs that OfTel were before them.
